What is Power of Attorney?

A Power of Attorney document permits a third party, such as a trusted family member or friend, to enact your financial or legal wishes when they are physically unable or lose the capacity to do so. Depending on the circumstances, there are different Power of Attorney documents. You must be at least 18 years of age before you can legally initiate any such documentation.


General Power of Attorney 

This legal document gives one or several people, referred to as your Attorney, the power to enact your financial or legal wishes. This person does not replace you but can act as your proxy. 

For example, you might purchase real estate and be required to sign important documents whilst overseas. A General Power of Attorney gives third parties the legal capacity to represent you and sign on your behalf. 

You can appoint this person for a definite or indefinite period and make changes at any point. 

Enduring Power of Attorney 

This document gives a third party the power to act on your legal and financial behalf when you can no longer do so. 

For example, you may fall ill and lose the ability to manage and make decisions about your legal and financial affairs. This document can only be prepared whilst you still have complete capacity to do so and it loses all force in the event of your death.
